|Nor do maximum penalties have anything to do with what a particular
|defendant will receive. If JK Rowling had fifteen separate felonies, a
|murder conviction, and was out on probation when she did this, she
|might get the maximum. The maximum penalty is just that, the sentence
|that a judge would give to the most hardened, unrepentant,
|incorrigible defendant imaginable.  What reporters should be reporting
|is the median sentence given to a first time offender given similar
|circumstances, but that takes research and knowledge and is
|substantially less sexy for clickbait than putting a great big number
|in the headline.

|cyber bullied by Beth from 2nd period is a lot different than a
|literal billionaire with the reach of the entire world stage with
|millions of followers, and news media. I would argue being bullied
|by Rowling is far more detrimental, and therefore her sentence
|should have more weight and severity.

|about someone with reach in the 10s of millions making false
|accusations about someone which could very reasonably result in
|her murder in her home country if someone believes it. The sheer
|amount of power being flippantly misused and directed against one

|bigots. Accusation and allegation aren't too far removed from
|each other in definition, but we don't do any favors in the
|discussion by saying she's been *accused* of being trans. That

|just a silly hang up on my end, but when we casually use words
|like that, there's just this vibe that some people actually

|When you say "they", who are you referring to specifically? I very
|much doubt that the Crown Prosecution Service or the presiding
|judge care how wealthy she is or how much tax she's paying. It's
|not like they are going to personally benefit in any way from her
|staying or personally lose out by her being deported, certainly
|not to such an extent that it would make sense to bend/break the
|rules. Whether the majority of the country agrees with her or not
|is totally irrelevant. Deportation isn't a process decided by a
|popular vote; it's a legal process with clear rules.

|to play devils advocate. Fundamentally, I feel like it
|comes down to the rules for thee but not for me type of thing.
|The justice system more often than not, has less to do with your
|level of guilt and more to do with how expensive your lawyer(s)
|is(are). While the scenario with Jo, seems to be clear cut
|guilty, the evidence is available for anyone to see, the crux
|really comes down to the sentencing side of things. While as you
|said the people directly in charge of whether she would get
|deported or not, don’t benefit from her charity, they have
|bosses to answer to, who have bosses to answer to, who may
|directly benefit from the charity. At the levels that we are
|talking about, politics have huge impacts on the outcome.

|deportation, the UK would simply be deciding whether to grant
|this request or not. The CPS and Judiciary are independent and
|not politically appointed. Bending the law to Rowling's
|benefit seems much more likely to damage the relevant
|individuals' careers than help them. Politicians have huge
|influence when it comes to changing the law but very little
|influence in specific cases. Even if a politician could
|influence the decision, it isn't obvious that they are
|incentivised to do so. The Labour Party aren't exactly anti-
|LGBT. Compromising judicial independence to help someone
|accused of cyberbullying would not go down well with their
|base, and it's not like they'd get credit from the Right Wing
|either. They have nothing to gain here. Far easier just to
|leave it to the judges and wash their hands of the whole
|thing. Finally, on a personal level, I can't see Keir
|Starmer (a former Director of Public Prosecutions) being okay
|with the Government meddling in this way. It runs contrary to
|deeply held principles of his and it would damage his own
|credibility.
